General Terms and Conditions

This document establishes the conditions that apply to sales between persons who wish to make a purchase on this website, hereinafter referred to as "the client", and BIOTASMART.

By using this website or requesting a purchase, the customer accepts the purchase conditions and our Data Protection policy, which the customer must consult and accept prior to purchasing the product. These purchase conditions may vary. It is the customer's responsibility to read them periodically, since those in force will apply at the time of purchase. 1/ Purpose and scope of application

The user declares that he/she is aware, at the time of placing the order, of the specific conditions of sale indicated in the information sheet for each product (duration, price, etc.) and expressly declares that he/she accepts them without reservation. Placing the order and its confirmation by the user makes him/her a customer and implies full and complete acceptance of the specific conditions of sale, applicable only to the order, as well as acceptance of the rest of the legal documents published both on the website and in the conditions of use and the privacy policy.

2/ Product information sheet and information provided

The information displayed on the website is accurate and free of typographical errors. In the event that at any time an error of this type occurs, which is at all times beyond the control of BIOTASMART, it will be corrected immediately.

3/ Languages ​​for the acquisition of products

Purchases made by customers will be understood to be binding only in Spanish.

4/ Price

All prices are indicated by default in Euros. The indicated price includes the taxes applicable to the transaction.

5/ Order confirmation and product availability

The customer places the order by clicking on the "Add to Cart" tab. The order is added to a total that includes all the items confirmed by the customer by clicking on the button illustrated by a shopping cart in the menu bar.

BIOTASMART reserves the right to not confirm an order for reasons such as time availability, an abnormal order or a suspicion of the buyer's age. Notwithstanding the above, BIOTASMART will inform the customer of such circumstances as soon as possible, offering, where possible, an alternative solution.

6/ Payment terms

To complete the purchase, the user may use any of the payment methods offered in each case when placing the order.

7/ Information requested

In accordance with the provisions of data protection regulations, we inform you that the personal data you provide us through our website or by sending emails will be processed by BIOTASMART as the data controller in order to carry out the requested transactions, as well as to receive periodic notifications through electronic means. The legitimacy of the processing lies in the provision of the requested services. You can find more information about the processing of your data for the purposes described in the privacy policy, which must be read, understood and accepted in order to use the services of this website.

BIOTASMART is committed to fulfilling the obligation of confidentiality of personal data, and has therefore adopted the necessary measures to prevent its alteration, loss, processing or unauthorized access, taking into account at all times the state of the technology.

In any case, all users have the right to exercise, at any time, the rights of access, rectification, limitation of processing, deletion, opposition, limitation of processing, and data portability that assist them, by sending an email to the address of our data protection officer info@biotasmart.com as long as they prove their identity. And if they deem it appropriate, they may contact the Spanish Data Protection Agency.

8/ Right of withdrawal, changes and returns

As a general rule, any customer has the right to withdraw from this contract within 14 days without giving any reason. In any case, in order to exercise the right of withdrawal, it is necessary that the product be returned together with all its components. Before returning the product, the customer must ensure that it is properly protected and sealed so that it does not suffer any damage during transport. Notwithstanding all of the above, the right of withdrawal and/or termination is excluded in those cases in which, due to the very nature of the goods being acquired, it is impossible to carry them out, without prejudice to the corresponding claim for damages suffered or that may put health and hygiene at risk. It will also not be possible to exercise the right of withdrawal if the following conditions are not met:

  • The product must be in perfect condition, as well as any accessories it contains.

  • The product must be accompanied by all accessories and complements.

To comply with the withdrawal period, the customer simply needs to send the communication to BIOTASMART.

In any case, the customer will return the products subject to withdrawal without any undue delay within a maximum period of fourteen (14) calendar days from the date on which he communicates his decision to withdraw, bearing the direct costs of the return.

It should be noted that NUTRITIONAL COACHING appointments do not have the right of withdrawal, since the service begins to be executed with the mere selection of the date to carry out the videoconference based on art. 103. a) of the Revised Text of the General Law for the Defense of Consumers and Users and other complementary laws.

The refund of the amount corresponding to the withdrawal will be made within a period of fourteen (14) calendar days from the date on which the decision to withdraw from the Contract has been effectively and unequivocally communicated and provided that the Seller has previously received the product. Otherwise, the disbursement may be withheld until receipt of the product or until the Consumer/User proves the return of the same.

The customer will be responsible for any decrease in the value of the product resulting from handling it other than that necessary due to its nature, characteristics or operation.

After analysing the returned product(s) and verifying their condition, the amounts received will be refunded. This refund will include the total amount of the purchase, including, where applicable, delivery costs, and will be made using the same payment method with which the product was purchased.

9/. Refund of amounts paid.

Refunds, where applicable, will be made through the payment method used for the purchase.

The price to be refunded is the one originally stated in the order. Once the correct condition of the returned product has been verified, BIOTASMART will proceed to refund the amount within a maximum period of 14 days from the date of termination of the contract.

10/ Applicable legislation. Submission to jurisdictions.

By placing an order, the customer agrees to subject the purchase to Spanish law, and therefore these General Conditions are governed by Spanish law and therefore, for any interpretative or contentious issues that may arise, Spanish law will apply.

The parties submit, at their choice, for the resolution of conflicts and waiving any other jurisdiction, to the courts and tribunals of the buyer's domicile and, for appropriate legal purposes, we remind customers that the European Commission has created an online platform for extrajudicial dispute resolution that is available at the following link, http://ec.europa.eu/consumers/odr/ .
